ان کا کہنا تھا کہ سپریم کورٹ نے اپنے فیصلے میں کہا تھا کہ این آر او کے تحت زیرِ التوا مقدمات پر عمل درآمد شروع کروانے کے لیے سوئس حکام کو خط لکھیں۔ جبکہ وزیرِ اعظم نے ایسا نہیں کیا۔ عدالتِ عظمٰی کا کہنا ہے کہ وزیرِ اعظم آئینی طور پر عدالت کے احکامات ماننے کے لیے پابند تھے۔ تاہم وزیرِ اعظم گیلانی نے فردِ جرم کی صحت سے انکار کرتے ہوئے اسے چیلنج کر دیا ہے۔

Pundits are still puzzling out the prime minister’s motivations for risking his job for Zardari, who has dismal popularity ratings and a long rap sheet of kickback, shakedown and other corruption allegations. Some see the 59-year-old prime minister finally shedding his unassuming personality and coming into his own.
-Another theory holds that Gilani wants to go out as a selfless political martyr who showed his unflagging party fealty to the very end. Such sacrifice would leave a dynastic legacy for his children, who also are involved in politics.
-Then there’s another option, according to party insiders: Zardari could pardon Gilani immediately after he’s convicted. (Washington Post)

Name of Khurshid Shah is also doing the rounds, as son of ‘South Punjab’ would become Sayasi Shaheed and Sindhi PM would assume the office to face the music, a perfect setting for ruling PPP before the next General Elections. The timing of the court orders and strategy of the government to delay it at least till the Senate Elections, would allow the PPP to get ready for the final showdown.

Asked if he would rather resign for the sake of the president, Gilani said if convicted of contempt, he would automatically lose office, so there was no need for him to quit.
“There’s no need to step down,” he said. “If I’m convicted, then I’m not supposed to be a member of the parliament.”
President Asif Ali Zardari: “There had been a lot of cases against him, and they were all politically motivated,” Gilani said, referring to Zardari.
“He has got immunity. And he has not got immunity only in Pakistan, he has transnational immunity, even all over the world.”

Pakistani Prime Minister Due in Court For Contempt Hearing

Prime Minister Yousuf Raza Gilani of Pakistan is due to appear Monday before the country’s Supreme Court, which plans to charge him with contempt in relation to a long-running struggle over old corruption cases.

Gilani is locked in a standoff with the Supreme Court justices, who are demanding that he ask the Swiss authorities to revive corruption charges from the previous decade against President Asif Ali Zardari and others.

Gilani has refused the court’s demands and could be jailed for six months if the justices find him in contempt. The court on Friday rejected an appeal by Gilani’s lawyers against the summons to face the contempt charge.

The lawyers have argued that the prime minister has not followed the court’s order because Zardari enjoys immunity in Pakistan and abroad as a president in office.

Gilani said in an interview over the weekend with the satellite news network Al Jazeera that he had an “extremely capable” lawyer and didn’t believe the court would jail him on the contempt charges.

If found guilty of contempt, the prime minister could be forced from office. But his lawyers have said he would keep his position unless electoral officials disqualified him.

Gilani served more than five years in prison between 2001 and 2006 on corruption charges brought by the previous military regime of Gen. Pervez Musharraf — counts he said were also politically motivated.

The corruption cases that the Supreme Court now wants reopened stem from money-laundering charges against Zardari and his late wife, former Prime Minister Benazir Bhutto. A Swiss court convicted them in absentia in 2003 of laundering millions of dollars.

After Musharraf granted a controversial amnesty in 2007 to Zardari, Bhutto, and thousands of other politicians and bureaucrats, Pakistan asked the Swiss authorities to drop the case. In 2009, the Pakistani Supreme Court ruled the amnesty was unconstitutional and called on the government to take steps to have the cases reopened.

The government has not done so, and the court apparently lost patience. Since Gilani is the head of the government, the court justices view him as responsible.

Gilani Gravity Lessons

From his wife’s multi million loan waiver, to his son’s alleged involvement in Hajj scandal. From friends and family involved in massive corruption cases to almost ritualistic shuffling in bureaucracy, hampering court investigation into several legal cases, the list goes on and on…

…bottom line… his blood group is “corruption +ve”.

Transferring high profile government officers at free will, to disrupt legal investigation into several matters of national importance, ranging from Hajj Scandal, Fertilizer scam to Swiss cases, there is a pattern to Gilani’s defiance towards rule of law. Still he totally gets to brag about his respect for Law by merely presenting himself to Supreme Court, once he is summoned there.

That’s ridiculous!
Its like, I respect you dad, but who gives a rats ass about what you ask of me, Huh !

He earlier indicated that memo case might lead to his ousting. Later he gathered courage and defiance over the matter, only after entire state machinery came out of the closet, hell bent to not allow and threaten the primary witness to the case, Mansoor Ijaz. Gilani even declared Army chief’s request to the apex court for independently probing into Memo case, an “unconstitutional and illegal” act.

According to a letter submitted to Supreme Court earlier this week by Gilani’s lawyer, he mentioned reinstating the judges of Pakistan to his list of services for judiciary. Yeah right!

Only if the people in this country received a daily heroin dose through some public ration program, that we would forget a massive Long March towards the capital which forced Gilani to announce the restoration of judges around 5:30AM early Monday morning of 16th March, 2009. Not mention the entire state machinery, police blockade, house arrests of several leaders, and ceasing of roads from entire province of Sind, was applied to stop the public from reaching Islamabad.

In his haphazard address restoring judges of Pakistan, b*****d goes onto say, “today I fulfilled the promise of Late Benazir”

Hello?

Army had refused to intervene, there were millions of people on roads, driving in huge convoys about to reach Islamabad any hour and, and a*****e gets to brag about his gift to Nation. Humph !

This dangerously shameless attitude of not learning from his mistakes is the reason why we worry for our country most.

Such is the intellectual meltdown of our ruling class and their followers, that it is almost sickening to allow their daily statements into even the most corrupt portions of one’s brain. I would rather see somebody shoot a cat, set it on fire or feed it to crocs, than allowing myself to watch his hollow public speeches and shameless self defense. Self acclaimed champions of democracy, with absolutely nothing to blame for shortcomings than their own; either stupidity or evil intentions.

I have high hopes for our collective national future, but I am Hopeless with Gilani. Regardless of him being convicted by Supreme Court today or not, I am sure even the gravity would fail to teach any lessons.

NOTE:

I felt the need to start a blog, because there were things I could not say in radio shows. Essentially ethics of broadcasting wouldn’t allow me.

KHURRUM DASTGIR KHAN OF PML-N said that executive of Pakistan is not abiding by the resolutions of the parliament or the decisions of the Supreme Court. He said that the parliament passes a resolution but the executive ignores it. He said that after the rejection of review petition there is no more hope left. He said that the people should ask their representatives that they are abiding by the law or not. He said that his party stressed on the problem of Balochistan but went in vain. He said that the people say that the agencies are involved in Balochistan. He said that talking about the personal rights is not treason against the country. He said that about 1500 settlers are also killed in the province of Balochistan. He said that the role of agencies should be finished in Balochistan. He said that an amnesty should be declared for the people of Balochistan gone astray. He said that the nationalist leaders do not represent the majority of the Balochistan people.

BABAR SATTAR A COLUMNIST said that the court has to follow a due process. He said that the courts can not deliberate on the wishes of the people. He said that Aetzaz is arguing that it can be observed that the decisions of the court are according to the law and constitution or not. He said that it is a dangerous argument by Aetzaz because it will not let any decision to be followed. He said that the government in Pakistan is not protecting the basic rights of the people. He said that in Balochistan people and agencies are killing each other. He said that we have handed over the national security issues to the military. He said that it is not the job of the military to judge that who is traitor and who is not.

NAYYAR BUKHARI OF PPPP said that according to his information a consensus has been achieved on twentieth amendment. He said that now the resolution of the twentieth amendment will be presented in front of the parliament.

ANSAR ABBASI A JOURNALIST said that the whole onus is on the Supreme Court at the moment. He said that the parliament is not playing its role. He said that the members of the parliament do not even know that what the 18th amendment all about was. He said that it seems that Aetzaz is taking lesson from Babar Awan because his arguments do not make any sense. He said that Aetzaz says no letter will be sent to the Swiss court and at the same time contempt of the court is not committed. He said that the court should only deliberate when it is needed. He said that America is dared to talk about Balochistan problem because we are the slaves of America. He said that our leaders do not have courage to protest to America. He said that America is responsible for state sponsored terrorism more than any body else. He said that we should talk to the people have gone astray towards the terrorism. He said that we should not hand over our problems to the military because it complicates things. He said that amnesty should be announced both for the people of Balochistan and tribal areas.

MOEED YOUSUF A ANALYST FROM AMERICA said that American government does not support the discussion on Balochistan in their country. He said that Pakistan is on target at the moment and there is a negative impression about it in the Washington DC. He said that the problem of NATO supply will be resolved and a levy will be charged on NATO containers.

Transparency International Pakistan says Gilani tenure has given a loss of Rs 8,500 billions in corruption so far. Still nincompoos and corrupts in government expect people to pay taxes like “responsible” citizens. Yes, people like us who pay taxes despite corruption are responsible and they are responsible for beeing ignorant.

People should go for a collective boycott of taxes and take back the country from these evil ruling elite.

ISLAMABAD: Pakistan has lost an unbelievably high amount, more than Rs8,500 billion (Rs8.5 trillion or US$94 billion), in corruption, tax evasion and bad governance during the last four years of Prime Minister Yusuf Raza Gilani’s tenure, Transparency International Pakistan (TIP) claims.

The TIP advisor, Adil Gillani, told The News that the real impact of corruption in the country’s economy is far more than what is generally estimated or what is formally uncovered. He believes that Pakistan does not need even a single penny from the outside world if it effectively checks the menace of corruption and ensures good governance.

It is generally believed that the four years of the present regime under Gilani had been the worst in terms of corruption and bad governance in the country’s history. Past records of corruption were broken and Pakistan started rising in the ranks of the most corrupt nations of the world.

There has been no check on corruption as the anti-corruption institutions like the National Accountability Bureau and Federal Investigation Agency instead of checking corruption have been siding with the corrupt.

These institutions have been helping the corrupt to get off the hook by distorting and mutilating the evidence in favour of the influential accused.
Adil Gillani, the TIP representative, who too has been haunted by the government during these years for producing corruption reports, explained that the TIP pointed out corruption of Rs390 billion in 2008, Rs450 billion in 2009, Rs825 billion in 2010 and Rs1,100 billion in 2011 under the present regime. The total of these identified cases of corruption is Rs2,765 billion.
In addition to this, he explained the following:

The minister of finance of the present regime himself confirmed corruption in FBR of over Rs500 billon per year, which makes the total Rs2,000 billion; Auditor General of Pakistan pointed out Rs315 billion corruption in 2010; Public Accounts Committee recovered Rs115 billion in 30 months till 2011; circular debt is Rs190 million; KESC was given Rs55 billion illegal benefits per annum since 2008; state-owned enterprises like PSO, PIA, Pakistan Steel, Railways, SSGC, SNGC are eating away Rs150-300 billion per annum; tax to GDP ratio in 2008 was 11%, which in 2011 has reduced to 9.1% instead of being increased.

Gillani explained that Pakistan’s Gross Domestic Product is worth US$175 billion and in the light of this the drop of 1.9% in the tax GDP means annual loss of US$ 3.3 billion. This confirms that FBR is losing Rs300 million per annum, which is annual additional loss since 2008 and stands at Rs1,200 billon in four years
The TIP adviser added that India’s tax-GDP ratio is 18%, and at that rate, Pakistan’s tax evasion/corruption in FBR is 9% of $175 billion, which is US$15.5 billion per year, i.e. Rs1,400 billion per year.

It is worth mentioning here that it is not only the Transparency International but there have been different international bodies including the World Bank and world capitals, which have been showing their concern over rising trend of corruption in Pakistan under the Gilani’s regime. It was mounting corruption and extremely bad governance, which even dithered the outside world to offer cash to Pakistan during 2010 and 2011 floods, which devastated different parts of Pakistan and affected millions of people.
At home the corruption became a fashion in such a shameless manner that even the cabinet ministers started openly pointing fingers at each other and even at the highest levels including the prime minister. Some even approached the Supreme Court but despite all this, corruption remained the hallmark of the present regime, which instead of curbing it started defending it in the name of democracy.

Hate Speech and Turkey’s Islamist Media Problem

A textbook case of hate speech in Turkish media: The story, entitled ‘Mishcon Indecency,’ suggests that “Zionists, who have been doing ethnic cleansing in Palestine for over a century” show that “they have no limit to indecency (or moral corruption)” because some members of the Israeli lobby in the United States supported a U.S. House of Representatives Resolution that was against Turkish interests. Note that the title includes the Turkish version of the common Hebrew name, Mişon (Mishcon), in an attempt to symbolize and generalize Jews. Although it is the Jewish lobby that supported the resolution in the U.S. Congress, the article uses ‘Mischon’ and ‘Zionists,’ not Jewish lobby or Israeli lobby. It also has the hidden message that suggests that ‘it was already known that Jews have no decency’ and ‘their’ decision to support the anti-Turkey resolution in the U.S. Congress ‘proves it’.

Although there is no universally accepted definition of the term hate speech, most states have adopted legislation to address the problems caused by it. Prejudice, racism, xenophobia, homophobia, Antisemitism and discrimination are all underlying motives of hate discourse. According to the Council of Europe Committee of Ministers Recommendation 97(20),

“hate speech covers all forms of expression which spread, incite and promote or justify racial hatred, xenophobia, anti-Semitism, or other forms of hatred based on intolerance including: intolerance expressed by aggressive nationalism and ethnocentrism, discrimination and hostility against minorities, migrants and people of immigrant origin.”[i]

The European Commission 2011 Progress Report on Turkey emphasizes that Antisemitism and hate speech in the media (targeting missionaries or Christians in general) remain an important issue. Despite national and international calls, the Turkish government has not addressed hate speech and hate crimes in the country. Therefore, Turkish media has absolute freedom in publishing reports and commentaries full of insulting and defamatory content. Not only are the issues reported with extreme manipulation of the facts (based on ideological and political affiliations of the newspaper), they often include hate speech.

For example, in the country’s ultraconservative Islamist newspapers Milli Gazete and Vakit (known as Yeni Akit since 2010), the staunch supporters of the ruling AK Party, one can find defamatory content about Armenians, Christians, Jews, gays, and AK Party’s political opponents. Moreover, these papers use ‘being of Jewish/Armenian/Greek origin’ or ‘having a Jewish relative’ or even ‘allegedly being of Jewish/Armenian/Greek origin’ as defamatory phrases to ‘vilify’ the targeted group or individuals (often political opponents of conservative groups, the AK Party and their allies):

A commentary appeared in Yeni Akit in November 2011, entitled ’Generals’ Jewish Son-in-laws,’ aims to vilify and defame the Turkish military, because some of its generals have son-in-laws who happened to be of Jewish origin. According to the article, it is “strange” that after the “discovery” of footage showing high ranking Army officers at the Wailing Wall (Western Wall), which is accepted as a holy site by the “Zionists,” it is now “discovered’ that “some generals have Jewish son-in-laws.” Here, the purposes is to attack the presumed opponents of the AK Party (and  the Islamist ideology the newspaper represents) by associating them with something or someone that is “Jewish,” as if it is something threatening, immoral or bad. 

In another story, the same newspaper attempts to vilify Büşra Ersanlı (a Turkish academic who has been detained on the charges of being a member of the KCK, the alleged urban wing of the terrorist Kurdistan Workers’ Party, PKK). The article’s title is ‘Ersanlı’s Jewish lover (Ersanlı’nın yahudi aşkı), in reference to Ersanlı’s former husband who is a Turkish-Jew. There is a clear effort to associate Ersanlı with something ‘Jewish,’ and more importantly, the article suggests that ‘the Jewish link’ shows the “truth about Ersanlı,” again, as if it is something concerning for the reader.  

What people see in the media has influence on their perceptions. Therefore, hate content shouldn’t be seen as just mere propaganda – it may actually provoke and incite violence:

The main sponsor of the event, a local wine company, had promoted the concert with banners saying ‘Take your wine and come enjoy the full moon,’ and ‘Tchaikovsky, wine and sunset: What else is there to say?’ A week before the event, Vakit began publishing commentaries (in its print and online editions) emphasizing that wine was to be served “right next to Prophet’s belongings” at Topkapı Palace which was “once filled with the voices of Ottoman soldiers reciting Quran before going to battle.” “This is how a country is destroyed” and “wine audacity in sacred courtyard,” read the titles of the newspaper.

In its latest report on the subject (Hate Crimes in the OSCE Region: Incidents and Responses), the Organization for Security and Cooperation in Europe (OSCE) underlines ‘intolerant discourse’ as an important factor contributing to the occurrence of hate crimes. Moreover, the OSCE Office for Democratic Institutions and Human Rights stresses that hate crimes “pose a serious threat to domestic and international security, thus undermining societal cohesion by sowing the seeds of conflict and wider-scale violence.”[ii] Therefore, they not only harm the individual or group targeted in the crime, but affect the entire community to which the victim belongs.

The Association for Social Change (ASC, Sosyal Değişim Derneği in Turkish) is a leading organization focusing on the hate issue in Turkish media. Their 2009 report, entitled ‘Hate Crimes in National Media: 10 Years, 10 Cases,’ covers the years between 1998 and 2008 and focuses on a large selection of newspapers that represents most political and ideological sides in Turkey.[iii] The ASC researchers investigated hate speech instances in ten categories including ethnic background, nationality, gender, sexual orientation, and religious affiliation. Of the 30,000 articles and commentaries investigated, the researchers analyzed 200 pieces in detail and provided ten ‘textbook cases of hate speech’ for each category.

According to this study, 79 percent of all material analyzed is characterized as ‘hate crimes’ leaving the hate speech with 21 percent. 24 percent of all hate crimes are related to ethnic identity, followed by those related to political identity (19 percent), sexual identity (16 percent), and religion (16 percent). Moreover, a staggering 47 percent of all hate speech instances are related to ethnic identity. Categorized as a single unit, ‘hate crimes and hate speech’ related to ethnic identity tops the list of ten categories with 42 percent. It is followed by religion (20 percent), national identity (11 percent), and political affiliation (11 percent). Of all the newspapers studied, Yeni Şafak, Milli Gazete, Vakit and Zaman – all conservative newspapers and staunch supporters of the AK Party – have the highest number of hate speech content about religious identity.[iv]

The study also revealed that there is more hate speech against certain groups in certain dates. For instance, before or on April 24 (Genocide Remembrance Day in Armenia) of every year, there was a recognizable increase in the negative and discriminatory discourse against the Armenians. Similarly, before or on March 21st (Nevruz), discourse against the Kurds and the Kurdish identity was more offensive. Another important finding that must be mentioned here is that hate speech about sexual orientation and identity is common in almost all newspapers regardless of their political and ideological affiliation.

Hrant Dink Foundation is another organization that is focusing on the hate issue in Turkish media. The foundation has an ongoing project called ‘media watch on hate speech’. The project allows readers to submit hate speech cases via the Internet to the project website. According to their latest reports, there is an increasing hate speech against missionaries and Christians in Turkey.[v]

I think part of the increase in hate speech against missionaries may be related to the emergence of “PKK is against Islam” themed reports and commentaries. Since early 2011, there has been a visible increase in stories in which PKK members ‘eat pork’ and ‘exercise shamanic rituals,’ while the security forces find ‘bodies of uncircumcised PKK members.’  Reports about ’PKK members converting in masses to Christianity to obtain financial support from Christian aid and missionary organizations’ are also being circulated regularly in Yeni Akit, Milli Gazete and Sabah. It is known that the government has been trying to counter PKK’s influence in country’s eastern provinces by a strategy, which I call 3D+I, or Defense, Diplomacy, Development and Islam. There is strong resistance to this policy among the Kurds, but the pro-government media seems to catch up with it.

Another organization, Kaos GL, the most active NGO promoting the rights of LGBT (Lesbian, Gay, Bisexual, and Transgender) community in Turkey, is focusing on homophobia in Turkish media. The organization has recently won a legal case over ‘perverts’ insult (in an article appeared in Yeni Akit) on Turkey’s High Court of Appeals (Yargıtay). Kaos GL’s lawsuit against Yeni Akit was initially rejected by two Ankara courts on the grounds that the newspaper was ‘within the limits of criticism.’ The Supreme Court of Appeals, however, overruled the previous decision stressing that ‘the freedom of the press does not encompass the freedom to insult the personal freedoms of individuals.’ Since the Supreme Court of Appeals is the highest court for reviewing verdicts given by courts of criminal and civil justice, its decision sets a precedent for future lawsuits.

The good news is, there is growing public attention on hate speech and hate crimes in Turkey. In January 2012, more than fifty NGOs announced that they have come together in a campaign to demand hate crimes legislation in the new Turkish constitution. The Campaign for Hate Crime Legislation (Nefret Suçları Yasası Kampanyası) is perhaps the most important step to date in Turkey for addressing hate speech and hate crimes. However, the AK Party, which has the majority in the parliament, has not taken any step for such legislation yet.

I think the hate speech problem in the Islamist and pro-government media shows yet another shortcoming of ‘Turkey as a model to the Middle East’ concept. It is very confusing that, the AK Party, which has been promoted as the ‘champion of democracy’ in Turkey and the ‘model political movement for democracy and development in the Middle East,’ has not addressed the problems caused by hate crimes. More interestingly, the newspapers, which have the highest Antisemitic, homophobic, racist, insulting, and defamatory content, are the ones that have been the closest media allies of the AK Party government.

UPDATE, February 6, 2012:

As I was doing my daily readings of Turkish media, I saw an article on habervaktim.com discussing the hate speech legislation campaign I mentioned above.

Here is a quick translation of what the article suggests:

Lately, while the so-called ‘hate speech legislation’ campaign has been introduced as if there is a hate speech problem in Turkey, it is discovered that Jews’ newspaper Şalom is behind provocative activities. Although hate crimes legislation is not in the agenda of the majority of the people, marginal groups are working to introduce the so-called problem in West’s agenda. Marginal groups such as those which portray sexual perversion in their activities are supported by those who claim to be the representatives of Jews, Greeks and Armenians in Turkey.

Here, the message is “the majority” doesn’t have a problem with hate speech and only “marginal groups such as those who portray sexual perversion” are supporting this issue because, in the background, “the Jew” supports them. It is important to note that the concept of “support/will of the majority” is used to “justify” certain policies by ultraconservative newspapers. The newspaper tries to avoid calling gays “perverts,” but make use of another homophobic phrase “sexual perversion,” while it also attempts to discredit those who support the hate crime legislation as if they are not the ‘real the representatives’ of the minorities in the country. The article also openly calls Şalom as the ‘behind-the-curtain’ mastermind of the ‘so-called hate crimes issue’ in Turkey, which the newspaper suggests is an attempt to discredit Turkey in the West.

Citizens for Free and Responsible Media, Pakistan: Summary of media consumer activism

 Summary of media consumer activism in Pakistan from Citizens for Free and Responsible Media, Pakistan, Saturday February 4, 2012:

We are a group of activists, academics, lawyers and journalists, citizens from all walks of life — essentially media consumers serving as an independent platform to voice public concern and through people powered reform, ensure that freedom and responsibility prevails in the media in Pakistan.

We, as concerned media consumers, came together united in our outrage against a morning show broadcast on Jan 17, 2012, links to which began circulating on facebook on Jan 20, 2012. In the next few days our online petition received over 5,000 signatories. In addition, we emailed a copy of the petition text to Samaa TV chairperson, Zafar Siddiqi with cc’s to several signatories (Annexure 1). We attempted to call and text message him en-masse in order to draw his attention too. He replied promptly, expressing his concern and regrets and promising that the channel would apologise (Annexure 2).

The following morning, Samaa TV broadcast an unconditional apology on behalf of the channel. However, the host Maya Khan’s words did not constitute a proper apology or acknowledgement of her transgressions.

We again emailed Mr Siddiqi, thanking him for Samaa TV’s apology and requesting an unqualified apology from the host (Annexure 3). He replied shortly afterwards, assuring us that guidelines had been put in place to prevent such transgressions from being repeated. He also said that since the host Maya Khan had refused to apologise unconditionally, her services and her show were being terminated (Annexure 4).

Many people also sent sms messages to Mr Siddiqi’s cell phone and called the Samaa TV offices, in addition to complaining at Pemra’s online feedback form. According to Pemra officials, they received some 400 complaints about that particular show. In addition, there was a threat of legal action against Samaa TV and contact was also initiated with corporations to withdraw commercials from such shows (both actions were stopped after Mr Siddiqi’s second email responding positively to media consumers’ complaints, but both remain real possibilities for future campaigns).

The degree of participation shown and encouragement by media consumers led us to come together under the umbrella of ‘Citizens for Free and Responsible Media (CFRM), Pakistan‘. We function as a non-hierarchal platform with decisions taken by consensus among the core group members, with inputs from media consumers who can now join us on our facebook page. People can also point out media transgressions and give their inputs here, to do their bit to “reduce the social cost of silence”.

The non-government organizations Network for Consumer Protection, Intermedia Pakistan (both headed by senior, respected journalists), and Bytes for All support our cause and had begun work on a legal petition against Samaa TV. Following the successful outcome of our social media campaign to force Samaa TV management to address concerns around the concerned morning show, they announced on Jan 29, 2012, that they would “withhold their planned legal challenge in the Supreme Court on privacy rights around this case, since one of the desired outcomes has already been achieved.” They stated that, “as now ourselves part of the Citizens For Free and Responsible Media, be available to lend any support required in realizing the objectives of this Forum.”

So far we have adopted a multi-pronged approach: online activism, as well as direct communication with the channel or person concerned, as well as lobbying through other channels. The possibility of legal action is not ruled out, nor is the possibility of approaching corporations to ask them to re-consider advertising in shows that violate basic ethics and human dignity.

A recent case we took up involves a reality show, Thori Si Bewafai on A-Plus TV. Within hours of our having started another petition the host of the show announced that he has quit the show, that the show was based on re-enactments and that the channel had not given this disclosure as they were ethically bound to do, and as per their agreement with him. (Annexure 6) (The channel subsequently removed the offending shows from its Youtube website and also the description posted earlier on its website copy pasted here verbatim before it was removed: “It’s hidden cameras reality television series that documents people who are suspected of committing betrayal /cheating on their partners on any term unfaithful to their close relative. Investigation by the headed by the team which carry out the task of spying on the suspected individual through different means and capturing all the evidence on the camera is the primary goal later on all the footages / investigation reports disclosed to grieved party / Complainant in front of camera. At the end of the show investigation team lead the complainant to the location where he/she will catch the subject red handed”).

CFRM’s goal is not to get channels banned or to get TV hosts or journalists fired, but to encourage channels to evolve their own set of guidelines and code of ethics in conjunction with senior producers, journalists and concerned citizens, to ensure that privacy and human dignity are not violated. We urge them to make these guidelines public.

We also urge them to incorporate a channel for media consumers to approach in case of complaint or redress, and appoint internal ombudsmen for this purpose.

We also urge the industry to revise the current ratings system, and align the ‘quality of content’ with the ‘quantity of viewership.’
